Fleetika Privacy Policy

1. Introduction and the Roles of the Parties

1.1. This Privacy Policy explains how we collect, process and protect data when you use the websites (including https://fleetika.com/), mobile applications, Services and Products of the Fleetika SaaS platform.

1.2. The Services are provided by LIMITED LIABILITY COMPANY "CARGOO", a company registered in Ukraine (identification code / EDRPOU: 45054344; registered address: Ukraine, 03150, Kyiv, Velyka Vasylkivska Street, building 143/2, office 18) ("Company", "we", "us"). "Fleetika" is a trademark and trade name (DBA — "doing business as") under which the Company operates this platform; Fleetika is not a separate legal entity. The Company is committed to keeping your information secure and managing it in accordance with applicable data protection laws (including the GDPR and the CCPA).

1.3. Within international data protection standards, Fleetika acts in two legal roles:

  • Data Controller: with respect to the personal information of Administrator users that we collect directly to create an Account, for billing, technical support and marketing.
  • Data Processor: with respect to any data (including information about employees, counterparties, geolocation, files and communications) that the Customer (a B2B user) uploads, transfers or connects to the Fleetika platform. In this case the Customer is the Data Controller and is solely responsible for having a lawful basis (consent) to collect and transfer such data.

2. Information We Collect

We collect, use, store and transfer different kinds of data, grouped as follows:

2.1. Data you provide directly (Account Information):

  • Identity data: the Administrator's first name, last name and job title, company name, tax number (VAT/EIN), and registered address.
  • Contact data: email address and phone numbers.
  • Profile and transaction data: login, an encrypted password, and payment history (processed by secure third-party payment gateways).

2.2. Technical and usage data:

  • IP address, browser type and version, operating system, time-zone settings and geolocation (derived from IP).
  • Information about how you interact with the platform (session data, traffic logs, access times).

2.3. Customer Data (User Content and Integrations):

As part of providing the Services, we process data that the Customer connects from third-party sources:

  • Telematics data: real-time GPS coordinates, speed, routes and sensor data received from third-party trackers.
  • Messenger data: metadata and the content of the Customer's interactions with its own users via bots.
  • Media files and documents: audio and video call recordings, electronic documents and invoices uploaded to the system.

3. Special Terms for Third-Party Integrations

Given the functionality of a logistics platform, Fleetika integrates with many third-party systems. Strict rules apply to processing such data:

3.1. Limited Use of Google APIs (Google Drive).

If the Customer uses the Google Drive integration to store audio and video calls, Fleetika requests only the minimally necessary scopes to write (create) files in a designated folder on the Customer's Google Drive. Fleetika does not read, scan or modify your personal files. When calls are recorded automatically, we do not listen to or analyze their content; our role is limited to the technical transfer of the encrypted file to the designated storage.

Fleetika's use of information received through Google APIs, and the transfer of that information to any other application, will adhere strictly to the Google API Services User Data Policy, including the Limited Use requirements.

3.2. Use of the Google Maps API.

The platform uses Google Maps services to visualize and optimize logistics routes. By using these features (including via the Customer's own API keys), the Customer agrees to comply with the Google Maps Terms of Service and the Google Privacy Policy. Fleetika does not control and is not responsible for how Google collects or uses data when this API is activated.

3.3. Telematics and GPS monitoring.

Driver geolocation data is sensitive personal information. The Customer (as Controller) is fully responsible for obtaining explicit, informed and documented consent from its drivers/employees for monitoring and transferring their geolocation data to Fleetika via third-party services (Wialon, MapOn, Samsara, etc.). Fleetika does not interact with the end data subjects.

3.4. Messenger integrations (WhatsApp, Telegram, Viber).

When messengers are connected, Fleetika acts solely as a technical interface. We process message content and metadata only to enable interaction within the platform and to archive it on the Customer's instructions.

4. How We Use Information

We use your personal information on the following lawful bases:

  • Performance of a contract: to provide the Services, manage your Account, deliver technical support and issue invoices.
  • Legitimate interests: to diagnose server problems, run analytics, prevent fraud and improve Fleetika's products.
  • Consent: to send you marketing updates, special offers and news (you may withdraw consent at any time).

Use of data for algorithms and AI (AI & Machine Learning). Fleetika formally states that we do not use the Customer's "sensitive" commercial data (the content of audio recordings or private messenger conversations) to train external (third-party) generative AI models, and we do not transfer it to third-party AI developers. However, the Customer agrees that Fleetika may use aggregated and fully anonymized telematics/logistics data (for example, travel-time history, traffic statistics, distances covered) solely for the internal training and improvement of the platform's algorithms. This is necessary to provide the Customer with route optimization, predictive analytics and accurate delivery-time (ETA) estimates.

5. Data Transfer and Disclosure

We do not sell your personal data to third parties. Your information may be disclosed only in the following cases:

5.1. Sub-processors: we use trusted third parties (currently our hosting provider, Linode) that act on our instructions under confidentiality agreements. A full, up-to-date list of sub-processors is provided to the Customer's Administrator on request.

5.2. As required by law: Fleetika may disclose personal information if we believe in good faith that we are obliged to do so to comply with applicable law, a court order or a lawful request from government (law-enforcement) authorities.

5.3. Mergers and acquisitions: in the event of a reorganization, merger, acquisition or sale of all or part of the Company's assets, your information may be transferred to the successor entity, which will remain bound by the commitments set out in this Privacy Policy (or a materially equivalent policy).

6. Data Security and Retention

6.1. Security. We apply modern organizational and technical security measures, including encryption in transit, firewalls and strict employee access controls, to prevent unauthorized access to, loss of or alteration of your information.

6.2. Retention period. Customer Data is stored for the duration of the commercial subscription. After the Agreement is terminated, we give the Customer a 30-day "transition period" to export data. At the end of that period, all commercial and personal data (including Customer content) is permanently deleted within 30–60 days, except for information we are required to retain to meet legal (for example, tax) obligations.

6.3. If unauthorized access to personal data (a breach) is discovered, Fleetika will notify the Customer's Administrator by email within 72 hours of confirming the incident.

7. Cookies and Analytics

Fleetika uses cookies (strictly necessary, analytics and functional) to distinguish you from other users and to improve the Website. You can configure your browser to refuse cookies, but this may affect the availability of some platform features. For more details, see our Cookie Policy.

8. Your Privacy Rights

Depending on your jurisdiction, you have the following rights:

  • The right to access your data and obtain a copy of it.
  • The right to rectify inaccurate data.
  • The right to erasure (the "right to be forgotten").
  • The right to restrict processing and to data portability.
  • The right to withdraw consent to marketing communications.
  • The right to lodge a complaint with a competent data protection supervisory authority.

9. International Data Transfers

Information is processed and stored in the jurisdiction(s) where our hosting provider's data centers are located. When transferring Customer data from the European Union (GDPR), we rely on the Standard Contractual Clauses (SCC) and a Data Processing Agreement (DPA).

10. Children's Information

The Fleetika platform Services are not intended for persons under 18 years of age. We do not knowingly collect information about children.
